Terms of Service

1. Description of the service

El Bujías (hereinafter, "the Platform") is a SaaS (Software as a Service) service designed for mechanical workshops in Spain. The Platform offers:

  • Customer and vehicle management
  • Work orders with a status workflow
  • Diagnostic videos and photos
  • Interactive quotes with customer approval
  • Communication with customers via WhatsApp, email and SMS
  • Invoicing with VeriFactu readiness
  • Appointment management and roadworthiness test (ITV) and service reminders
  • Team time-tracking

2. Registration and accounts

To use the Platform, you must create an account by providing truthful and up-to-date information. When you register:

  • You become the owner of the workshop created and are responsible for its management.
  • You are responsible for keeping your access credentials confidential.
  • You can invite other members (mechanics, administrators) to your workshop.
  • You must be over 18 years of age or have the legal capacity to contract.

3. Free beta and pricing

  • Free beta: Access is free, with all features included, up to and including 30 November 2026.
  • Unlimited users: Included, during the beta and after it.
  • Price: From 1 December 2026 the subscription is €70 a month, VAT included: one plan with every feature, no extra modules and no setup fee. If you subscribe before that date, nothing is charged until 1 December 2026.
  • If you sign up from 1 December 2026: you get 14 days of full access from signup, free and without a card; after that, your account becomes read-only unless you subscribe.
  • Early-bird rate for beta workshops: workshops that subscribe before 1 December 2026 keep the price they subscribed at for as long as they stay subscribed, even if the list price later rises for new workshops. If you cancel and subscribe again, the list price in force at that time applies. You can cancel without penalty at any time.
  • If you do not subscribe: your account becomes read-only. You can still view, print and export all your data — including issued invoices — but not create or change anything. Nothing is deleted.
  • No commitment: You can cancel your account at any time.

4. User obligations

By using the Platform, you undertake to:

  1. Use the service lawfully and in accordance with these Terms.
  2. Not use the Platform for illegal or unauthorised purposes.
  3. Not attempt to access the data of other workshops or users.
  4. Keep the information of your account and workshop up to date.
  5. Comply with the applicable data protection legislation (GDPR/LOPD) regarding your customers' data.
  6. Obtain your customers' consent before sending them communications through the Platform.

5. Data ownership

You retain ownership of all the data you enter into the Platform, including customer, vehicle, work order, invoice, video and photo data.

  • The workshop is the Data Controller of its customers' data.
  • El Bujías acts exclusively as the Data Processor, processing the data according to your instructions and for the provision of the service. See our Data Processing Agreement (DPA) for more details.
  • We will not sell, rent or share your data with third parties for commercial purposes.

6. Service availability

We strive to keep the Platform continuously available, but we do not guarantee 100% uptime. The service may be temporarily unavailable due to:

  • Scheduled maintenance (notified in advance where possible)
  • System updates
  • Force majeure
  • Unforeseen technical problems

7. Intellectual property

The Platform, its code, design, brand, logos and documentation are the property of El Bujías and are protected by intellectual property laws. No right over the intellectual property is granted other than the limited licence to use the service for the duration of the subscription.

The vehicle make and model suggestions are drawn from the vehicle registration statistics that Spain's Dirección General de Tráfico (DGT) publishes as open data («Fuente: DGT, microdatos de matriculaciones» — Source: DGT, vehicle registration microdata), reused under the conditions of Ley 37/2007 and Real Decreto 1495/2011. El Bujías has no connection with the DGT, which neither sponsors nor endorses the service, and the Platform consults nothing from the DGT while you use it.

8. Termination and data export

  • You can cancel your account at any time.
  • Before cancellation, you may request the export of your data in a standard format.
  • After cancellation, we will retain your data for 30 days before its definitive deletion.
  • Data subject to legal retention obligations (invoices, time records) will be kept for the legally required period.

We reserve the right to suspend or cancel accounts that breach these Terms, with prior notice to the user except in cases of serious infringement.

9. Limitation of liability

To the maximum extent permitted by law:

  • The Platform is provided "as is" and "as available".
  • We will not be liable for indirect, incidental, special or consequential damages arising from the use of, or the inability to use, the service.
  • Our total liability will be limited to the amount paid by the user over the last 12 months.
  • We are not responsible for the accuracy of the data entered by users nor for the communications sent to their customers through the Platform.

10. Applicable law and jurisdiction

These Terms shall be governed by and construed in accordance with Spanish law. For any dispute arising from these Terms, the parties submit to the Courts and Tribunals of the city of El Bujías's registered office, unless consumer protection legislation provides otherwise.

11. Amendments

We reserve the right to amend these Terms at any time. Changes will be notified to registered users at least 30 days in advance. Continued use of the service after notification constitutes acceptance of the new Terms.
